Elon Musk’s attorneys have asked a federal appeals court to strike down a provision of his 2018 consent decree with the U.S. Securities and Exchange Commission, which requires a Tesla Inc. attorney to verify certain of his posts on Twitter.
In a document filed late Tuesday with the 2nd Circuit Court of Appeals in Manhattan, Musk’s lawyers called the prior approval requirement a “government-imposed muzzle” that inhibits and chills his legal speech. and violates the US Constitution.
